Mother Charged in Baby's Death Appears in Court

Ashley Hayes reporting A Provo woman charged in her infant son's drowning appeared in court this morning.

Prosecutors have charged 27 year-old January Krebs with two misdemeanors in connection with her baby's death.

Krebs has said the death was accidental.

Krebs seemed confused about her rights. When judge Steven Hensen asked January Krebs if she was represented by a lawyer, she said no. She was adamant a court secretary told her over the phone she didn't have the right to a lawyer.

Judge Hensen advised Krebs to fill out an affidavit to request a court appointed attorney. On the way out of district court, Krebs would make no comment on camera.

In February Krebs' 14 month old son died after being left alone with his two-year-old brother in the bathtub. Krebs said it was an accident. She said she left him only for a few moments to take some towels out of the dryer.

Police found alcohol on the floor in Kreb's house and began an investigation.

Donna Kelly, the prosecutor in this case, says while Krebs didn't harm her child intentionally she is still responsible for his death.

Donna Kelly/ Deputy Utah County Attorney: "She has given significantly inconsistent statements to a number of people after the events occurred. But the facts at the time that this child died and her statements at the time the child died support the charges."

After appearing, Krebs left the courthouse to file for a public defender.
