HAMDEN, N.Y. (AP) — An 11-year-old upstate New York boy who was hospitalized after an all-terrain vehicle accident has died.
Police say Nicholas J. Dungan was driving with his 9-year-old brother in Hampden last Tuesday when he lost control of his ATV after turning off a rural road. He flipped his ATV into a ditch and was pinned beneath it.
Dungan was airlifted to Albany Medical Center with head injuries. He died Friday.
His brother wasn't injured.
The Delaware County Sheriff's Office says both were wearing helmets at the time of the accident. Deputies believe the older boy was speeding.
Officials say the boys were riding on the road illegally. No charges are pending.
