Deputies unsure what to do with 'Diaper Boy'

HOLLADAY -- The Salt Lake County Attorney will consider charges again, despite past failures in prosecuting a guy who flashes his diaper to young children.

The most recent incident happened Tuesday in a Holladay driveway near 4500 South and 2900 East. Lt. Don Hutson, spokesman for the Salt Lake County Sheriff's Office, says the man pulled down his pants and showed off his diaper to three young children, ages 4, 4 and 6.

Sheriff's investigators say 31-year-old Barton Bagnes, aka "Diaper Boy," has done this three times now.

In both 2007 and 2008 Barton Bagnes went to court on charges of lewdness involving a child. Both times he walked. The challenge is that what Bagnes does isn't specifically outlawed under the statute.

County attorney spokesperson Alicia Cook says it falls into a gray area. "What we would call a catch-all clause, which says any other act of lewdness that involves a child is also a violation of the statute," she said.

Bagnes became a registered sex offender after a conviction for lewdness involving a child back in 2000.
