SALT LAKE CITY (AP) -- A Murray man will spend up to five years in prison after admitting he threw his girlfriend's 2-year-old son across a room last year, killing the child.

Phillip Justin Guymon pleaded guilty to second-degree felony child abuse homicide yesterday in 3rd District Court.

In a plea deal, he was sentenced as if the charge were a lesser crime, although a judge said he would ask the state board of pardons to make sure Guymon serves "every single day of the five years."

Jaden Cangro died in July 2006 after Guymon threw him nine feet across a bedroom. The child landed on his head.

Guymon initially told police the child was crying and had fallen out of bed. He later acknowledged being frustrated because Jaden would not go to bed.

An autopsy showed the boy had old and new injuries, including bruises, fractured ribs and a brain injury that could have been caused by violent shaking.
