PROVO -- A Provo man charged in the rape and murder of his aunt has pleaded not guilty.
Damien Candland entered the plea in 4th District Court Thursday to charges of aggravated murder, rape and obstruction of justice in the death of Amy Candland. The woman's body was found in Hobble Creek Canyon in February.
Court documents show that Amy Candland, 41, had told a friend she was terrified of her nephew and wanted him out of the house they shared.
The Daily Herald reports prosecutors now have 60 days to announce if they'll seek the death penalty against Damien Candland. His next court hearing is set for Dec. 9.
