Charges filed against man caught in girls' locker room

Prosecutors have filed charges against a serial Peeping Tom with a long history of arrests.

Prosecutors charged Brian Richard Lee with burglary, a third-degree felony, and misdemeanor charges of lewdness and voyeurism.

The charges were filed after students at Brighton High School identified Lee as the man hiding behind a shower curtain in the girls' locker room with his pants down. It happened last week during an after school dance performance.

Police arrested Lee as he was getting into his car.

Lee has a history of similar arrests that date back to the 90s, and he's been caught at several schools in Davis and Weber Counties.

Prosecutors say, in this most recent case, they filed the charges based on the facts of the situation.

But Lee's criminal history could be a factor when he is sentenced. Alicia Cook, with the Salt Lake County District Attorney's Office, said, "So in terms of the sentence they get, or the possible treatment they're ordered to complete if they are incarcerated in a certain facility, or if they're given the opportunity of probation, we can still look at them like a sex offender, even if they're not placed on the registry."

Lee has never been convicted of a felony. Police told us he pleaded down many of his cases to misdemeanors, but prosecutors say his past could affect any plea negotiations in this case.

If he's convicted of the burglary charge, Lee could spend up to 5 years in prison.

The lewdness and voyeurism charges carry penalties of up to 6 months in jail.
