4 people face murder charge in Millcreek man's death

MILLCREEK — Four people have been charged with murder in the death of a Millcreek man found dead in his girlfriend's apartment in May.

Gildardo Toledo, 32, was found dead May 29 after neighbors called to report that the sliding glass door of an apartment at 875 W. Meadowbrook Expressway had been left open about four days, according to charges filed Wednesday in 3rd District Court. A gunshot had reportedly been heard in the area about 4 a.m. on May 25.

Four people — Alisha Hope Moore, 28; Richard Trujillo, 27; Francisco Garcia, 34; and Sarah Ortiz, 24 — are facing murder and various other charges after police say they went to rob Toledo and ended up shooting him in the struggle.

Moore told police she had been with Toledo in the early morning hours on May 25, including using his cellphone to send text messages to Ortiz up until 3:55 a.m., charges state. Moore told police she left, later returning with Ortiz, Trujillo and Garcia to rob Toledo.

Moore arrived first, charges state. She was joined by Garcia, who opened a back door for Trujillo and Garcia.

Toledo attempted to grab the .45-caliber handgun that Trujillo allegedly pointed at him, starting a struggle, charges state. Garcia threw a bottle at Toledo, and Trujillo fired, striking Toledo once, killing him, according to the charges.

The group fled, reportedly stashing the gun in some bushes and destroying the SIM card from Ortiz's phone that had received the text messages from Toledo's phone, charges state. Police say Trujillo retrieved the gun the next day and sold it.

All four are charged with with murder and aggravated robbery, first-degree felonies.

Trujillo is also charged with obstructing justice and possession of a firearm by a restricted person, second-degree felonies. Ortiz is also charged with obstructing justice, a second-degree felony.
