SPANISH FORK — A Utah County man is in jail after police say he sent sexually explicit emails to an undercover Utah County sheriff's deputy portrayed online as a 13-year-old girl.

Nicholas Robert Terry, 25, of Spanish Fork, used his own name in the emails, though allegedly said he was 16 years old. Police say he sent a sexually explicit picture and asked for others in return.

In February, Terry sent an email asking to "meet up and have some fun," according to a police affidavit filed in 4th District Court. After further advances and requests to meet, the deputy posing as a young teen arranged to meet in Provo with Terry.

Detectives followed Terry from his home to the location in Provo, where he was met by other officers. He had an unopened condom in his pants pocket, the affidavit states.


He also admitted to saying he was 16 for fear that if my persona knew he was really 25 that my persona would not talk with him.

The man admitted to having sexual conversations through email with a girl he believed was 13 years old, according to police. "He also admitted to saying he was 16 for fear that if my persona knew he was really 25 that my persona would not talk with him," the deputy wrote in the affidavit.

Terry was booked into the Utah County Jail Wednesday for investigation of attempted rape of a child; sodomy on a child; attempted aggravated sexual abuse of a child; enticing, soliciting, seducing or luring a minor by the Internet; and other offenses.

A search of court records indicates Terry pleaded guilty to assaulting a prisoner while incarcerated in 2007, attempted dealing materials harmful to a minor in 2011 and assault in 2013.
