RENO, Nev. (AP) — A lawyer for the Utah family of a contract worker killed in an accident at a Nevada gold mine in 2011 says they've settled a wrongful death suit with Newmont USA subject to a judge's final approval.
Newmont had claimed a tire repair contractor held any civil liability for its 21-year-old employee overcome by toxic fumes while fixing a giant tractor tire at the South Area mine near Carlin, about 275 miles east of Reno.
The U.S. Mine Safety and Health Administration earlier fined Joe Ashdown's employer, Purcell Tire & Rubber Co. of Missouri, $168,000, and Newmont $112,000 for violations related to his death.
A Salt Lake City lawyer representing Ashdown's estate, told The Associated Press the two sides have reached an agreement.
But Randall Edwards says he can't discuss terms of the "confidential settlement."
