(KSL News) Brain damage. That's the latest argument for a new trial for a convicted Utah killer on death row.

Von Lester Taylor is convicted of escaping a halfway house in 1990 and breaking into a Summit County cabin. Taylor shot three people inside the cabin. Two died. He then kidnapped two girls and set the cabin on fire.

Taylor's attorneys say they have a mental evaluation that was never entered into evidence during his trial, suggesting Taylor may suffer brain damage.

Prosecutors say they also have new evidence showing Taylor deserves the death penalty. The Utah Supreme Court is hearing Taylor's appeal.
