TULSA, Okla. (AP) — An attorney for a former Oklahoma reserve deputy convicted of second-degree murder in the death of an unarmed man has submitted a letter from a juror who expressed regret.
The Tulsa World reports (http://bit.ly/1TFwWqW ) that Robert Bates' attorney filed letters of support Friday. They include one the lawyer says is from a juror asking for probation for Bates because the juror believes "in my mind and heart" that Bates is not guilty. The juror wasn't identified.
Bates was convicted in the shooting death of Eric Harris during a gun-sales sting. The 74-year-old Bates said he mistook his handgun for his stun gun.
Bates' attorney is also asking for a new trial.
The jury has recommended a four year prison sentence. Sentencing is scheduled for May 31.
