WHITE PLANS, N.Y. (AP) — A Judge has denied a lawyer's request to postpone a trial until next fall because she is in the sixth month of a high-risk pregnancy.
Deborah Misir represents former vice chairman of the Queens Republican Party Vincent Tabone. His trial is set for January in White Plains.
Misir has asked federal Judge Kenneth Karas to delay the trial because her doctors advised her to avoid stress.
In denying the request, the judge said a second lawyer working with Misir was "an experience trial attorney" who had tried cases on his own.
According to The New York Times (http://nyti.ms/1xV76pI ), the judge said delaying the trial would affect Tabone's co-defendant, Democratic state Sen. Malcolm Smith.
Both defendants have pleaded not guilty to bribery and conspiracy. Their first trial ended in a mistrial.
