DA seeks appeal in ex-officers' manslaughter case

SALT LAKE CITY (AP) — Salt Lake County prosecutors are asking the state attorney general to appeal a judge's decision to throw out a manslaughter case against an ex-West Valley detective who fatally shot an unarmed woman he thought was trying to run over him.

A 3rd District judge determined after a three-day preliminary hearing earlier this month there wasn't enough evidence to proceed with a manslaughter charge against Shaun Cowley.

Cowley shot and killed 21-year-old Danielle Willard in November 2012 as she backed out of a parking space.

District Attorney Sim Gill says the case should have gone to a jury. He said in Thursday's request for appeal that Judge L.A. Denver didn't apply the appropriate legal test when he ruled prosecutors failed to present any evidence that Cowley's "conduct was not legally justifiable."
