Sam Penrod Reporting There is yet another delay in the murder case against Timmy Brent Olsen. He's the man suspected of murdering missing Spanish Fork teenager Kiplyn Davis back in 1995.

It has been a year now since prosecutors here in Utah County filed charges against Timmy Olsen. And the case has made little progress, because in that year, Timmy Olsen has still not personally appeared in court to hear the murder charges against him.

Up until now, it was because he was in federal custody because of the perjury case against him, which ended in convictions for lying about what he knows and his own involvement in Kiplyn's death and disappearance. This time, it is because he is resisting efforts to be brought to court as he sits in federal custody.

He has to be processed through the federal prison system on his twelve year sentence and once that happens, the judge in Utah County can order to bring him here. Today, Kiplyn's parents attended the hearing and are still pleading with anyone who knows what happened to their daughter to come forward, including the two men who are Kiplyn's former classmates who are about to face similar perjury trials in federal court.

Rucker Leifson and Chris Jeppson will stand trial in February and March, similar to the case that Olsen was convicted in. Prosecutors in Utah County say even though it seems the murder case is stalled, it is important to make sure there are no legal technicalities that could derail the case altogether.

The judge set the next court hearing for early March to try and sort out exactly when Olsen can be ordered to appear in court.
