Investigation: Homeowner justified in deadly shooting

SALT LAKE CITY -- The Salt Lake County District Attorney's Office has chosen not to pursue charges against a homeowner who shot and killed a burglar on Nov. 8.

Police say James Brandon shot Kyle Poulton while Poulton attempted to break into his Kearns home overnight. Police found Poulton dead in the street and later arrested his accomplice who got away.

The district attorney's office says, "Mr. Brandon had a real, and legally justified, fear for the safety of his family and believed he was attempting to prevent his home from being burglarized."

The district attorney's office said the use of deadly force was justified.
