BLUFFDALE -- The man shot and paralyzed by his neighbor during a neighborhood watch dispute now faces criminal charges.
David Serbeck is charged with three counts of unlawful sexual activity with a minor. According to the probable cause statement, Serbeck engaged in a sexual relationship with a 17-year-old girl back in 2006.
Serbeck left the courtroom this past July a victim, but he will soon be back as the accused. According to court documents in 2006, Serbeck invited a then 17-year-old girl identified as S.G. over to his home and kissed her. Then in December of the same year the two began a sexual relationship which included them acting as boyfriend and girlfriend.
Four years later Serbeck now faces three charges of sexual activity with a minor.
Skordas represents Reginald Campos, the man who shot and paralyzed Serbeck during an argument as Serbeck was working neighborhood watch. She says she was approached by S.G and two additional women with similar stories during the trial. She hinted at their allegations when explaining to the judge why Campos showed little remorse for what he did.
"She really felt that once she knew he was in a wheelchair, he couldn't hurt her anymore. It's as simple as that," Skordas said.
She's now preparing to argue for a new trial but says little of S.G.'s story would come into play.
"The allegations of sexual abuse are not relevant to Mr. Campos' trial. The only part that is relevant are the lies that he told her, because there is a rule of law that says if somebody lies, you can, in some instances, bring the lies to the evidence of the laws to the attention of the jury," Skordas said.
Serbeck had been patrolling his neighborhood as part of neighborhood watch in 2009 when he confronted some teenage girls, one of whom was Campos' daughter. The girl told Campos about the incident, and that led to the confrontation and subsequent shooting. Campos was sentenced in September to three years to life in prison.
Meanwhile, David Serbeck has been ordered to report to the Salt Lake Metro Jail where he will be booked and released. He was not aware of the charges until we contacted him and declined to comment until he'd spoken with a lawyer.
