SALT LAKE CITY (AP) -- The Utah Court of Appeals has upheld the conviction of a 68-year-old woman who fatally hit a bicyclist back in 2004.
Today, the court rejected Elizabeth DeSeelhorst's argument that there was insufficient evidence that she acted with criminal negligence.
Last year, she was convicted of negligent homicide in the death of 25-year-old Josie Johnson. DeSeelhorst hit and killed Johnson with her S-U-V in Big Cottonwood Canyon back in September 2004.
A judge sentenced her to three years of probation, including six months of home confinement. She was also ordered to serve more than 300 hours of community service and pay more than $4,600 in fines and more than $18,000 in restitution.
DeSeelhorst is the wife of the Solitude Ski Resort owner.
Johnson's death led to the creation of a statewide bicycle coalition and an annual memorial bike ride.
