LOGAN — A former emergency room technician found guilty of sexually assaulting an unconscious patient was sentenced to prison Tuesday.
Hal Lavaun Weston, 47, was sentenced in 1st District Court to five years to life in prison. In May, he pleaded guilty to forcible sodomy, a first-degree felony, in 1st District Court.
Weston, an emergency room technician at Logan Regional Hospital, pleaded guilty in May to performing oral sex on a man who was intoxicated and passed out and had been placed under arrest by police. The man passed out while being taken to jail, so officers took him to the hospital, still in handcuffs.
While left alone and still unconscious, and while the arresting officer was filling out paperwork behind a curtain, Weston assaulted the man. The sexual assault was discovered by the officer who walked in on Weston.
The man, who was later convicted of intoxication, has filed at least two civil lawsuits — one federal, one state — that were still pending Tuesday.
