Charges: Man tried to take Millard County sheriff's deputy's gun, Taser

FILLMORE — A Fillmore man was charged Monday for allegedly trying to take a sheriff deputy's gun and Taser during a confrontation.

Garrett Kinyon, 19, is charged in 4th District Court with attempted disarming a police officer of a firearm, a first-degree felony; attempted disarming a police officer of an energy device, a third-degree felony; failure to stop at the command of police, a class A misdemeanor; and interference with an arresting officer, a class B misdemeanor.

On Saturday, a Millard County sheriff's deputy approached Kinyon after receiving reports that he was "charging on foot at moving vehicles" at 50 N. Main, court documents say.

Kinyon allegedly ignored the deputy's commands and began running from him. Eventually, the deputy caught up to Kinyon and "told him to stop or he would get tased," according to court documents.

Charges say Kinyon continued to run from the deputy, who deployed his Taser on him. The Taser had no effect, the deputy reported.

The deputy later took Kinyon to the ground, at which point Kinyon allegedly grabbed the Taser.

"After releasing my Taser holster, (Kinyon) then grabbed my pistol and began to pull on it. I also grabbed (it) to prevent the subject from removing my pistol from the holster and gave him verbal commands to let go of my gun," the deputy says in court documents.

Kinyon allegedly began running from the deputy again. The deputy reported he used his Taser on Kinyon a second time, this time causing him to fall to the ground. A sergeant arrived and helped arrest Kinyon, but he continued to be uncooperative, charges state.

Police also believe Kinyon was "under the influence of some unknown narcotic" at the time of the encounter, according to court documents.

Kinyon is currently being held in the Millard County Jail. His initial court appearance is scheduled for Wednesday.

Kinyon was charged with class A misdemeanor drug possession on Aug. 12, court records show. He was also charged with purchase, possession or consumption of alcohol by a minor, a class B misdemeanor, on March 6. Both of those cases are ongoing.
