Evidence hearing in Shurtleff criminal case postponed until February

SALT LAKE CITY — Arguments over evidence state prosecutors believe the Department of Justice is holding back in the criminal case against ex-Utah Attorney General Mark Shurtleff won't be heard until February.

Third District Judge Elizabeth Hruby-Mills postponed a hearing scheduled for Tuesday to Feb. 17.

Davis County Attorney Troy Rawlings requested the delay last week, saying he is working with the DOJ and the FBI to get the documents he is seeking.

Rawlings filed a motion earlier asking the judge to force the federal agencies to turn over evidence gathered during investigations of Shurtleff and his successor John Swallow. The DOJ has said it has provided the material it deems relevant to the case.

Shurtleff's attorney, Richard Van Wagoner, joined Rawlings' motion to compel the federal government to produce the documents. He also did not oppose the request to delay the hearing.

"Mr. Shurtleff is now informed that the FBI concedes it possesses additional material information that bears on the Shurtleff and Swallow cases, and that it will be producing at least some of the material information the state has been asking for," Van Wagoner wrote in a statement Monday.

Van Wagoner said he was also told the evidence would come only from the FBI and not other federal agencies, including the DOJ. He said he doesn't know if it would include specific information he has requested from the state.

Rawlings wants to continue the hearing to give his office and Shurtleff time gto look over the evidence to "determine the extent to which it appears complete," according to Van Wagoner.
