SALT LAKE CITY (AP) -- An adult novelty shop owner has lost an appeal of his conviction for selling an obscene video to a minor -- who was actually a police decoy.
Thirty-eight-year-old John Haltom of Lincoln, Nebraska served 30 days in jail for his 2003 conviction of dealing in material harmful to a minor. Haltom sold the material to a minor at Doctor John's Lingerie and Novelty Boutique in Midvale.
Haltom appealed the conviction saying the trial court was wrong in denying his motion to dismiss the charges claiming entrapment by police and his own employee.
The Utah Court of Appeals said there was no evidence that the employee had talked with the Midvale City police officer who made the arrest.
A message left for Haltom's attorney was not immediately returned.
Haltom owns adult shops in Midvale and Roy, Utah; four in Nebraska; two in Missouri; and one each in Iowa and Colorado.
