Sam Penrod ReportingOrem police are investigating a case of road rage that escalated to the point of one person pulling a gun, and police say the man who pulled the gun should have known better.

It was at the intersection of 8th North and 9th West in Orem yesterday that two cars tried turning at the same time. One car honked at the other and the driver responded by pulling a gun.

Police say 29-yearold Brad Smoot of Lehi brandished a handgun at another driver, apparently in response to being honked at. The other person called 911 and police located Smoot several blocks away.

With guns drawn officers got Smoot out of his vehicle and discovered a loaded .38 caliber pistol in the suspect's waistband. It turns out Smoot holds a concealed weapons permit, but police say that is no license to go around threatening people with a firearm.

Smoot was arrested on charges of using a dangerous weapon in a fight, which is a class A misdemeanor. His pistol was confiscated as evidence in the case and police took Smoot's concealed weapons permit away.

A decision on whether will Smoot will get to keep his permit will be decided in the next few weeks by the state Department of Public Safety, which issues concealed weapons permits in Utah.
