(KSL News) -- A judge has sentenced a former prison guard to up to five years on the other side of the bars, for raping a female inmate.
Louis Poleate of Layton accepted a plea bargain in the rape charge. However, Poleate's attorney plans to file a motion to withdraw the guilty plea. He says a letter to the judge from a cellmate of the alleged victim says the two made up part of the story.
Under Utah law there is no such thing as consensual sex between a prison guard and an inmate.
