(Salt Lake City-AP) -- The day-care provider arrested after a one-year-old boy was rushed to the hospital last week is out on bail.

40-year old Maria Abigal Tiscareno was arrested yesterday on child abuse charges.

The operator of Abby's Child Care was taken into custody without incident on second degree felony child abuse.

Nathan Malineux remains in critical condition at Primary Children's Medical Center.

The boy was dropped off by his father at the day care early Friday morning. Tiscareno told health department officials that she picked up the crying baby later that morning to feed him and noticed his body was "loose" as he spit up milk.

The infant's two-year-old brother was placed in D-C-F-S custody Friday and returned to his father Tuesday.
