(Salt Lake City-AP) -- A judge today rules that a nine-month old boy who ingested drugs earlier this week will remain in state custody.

The little boy was taken to the hospital Monday by his mother and her boyfriend after he became lethargic and began vomiting.

Blood tests showed the infant had cocaine and methamphetamine in his system.

In a court hearing today, a judge upheld the Division of Child and Family Services' decision to take custody of the boy.

A hearing for further procedures in the case is scheduled for December 19th.
