(Salt Lake City-AP) -- The attorney for Brian David Mitchell is leaving the Salt Lake Legal Defender's office.

A state court spokeswoman says David Biggs will be replaced as the lawyer for the suspect in Elizabeth Smart's kidnapping.

Mitchell and his wife Wanda Barzee are accused of kidnapping Elizabeth Smart from her Salt Lake City bedroom in 2002. The couple are charged with aggravated kidnapping, aggravated sexual assault and aggravated burglary in Smart's kidnapping.

Today a judge found Barzee incompetent to stand trial and ordered her to go to the Utah State Hospital. Her competency will be reviewed at another hearing April 15.

Mitchell's competency hearings are scheduled for later this month.
