Former BYU Baseball Player Sentenced to Jail for Sex with Minor

(Provo-AP) -- A judge has sentenced a former B-Y-U baseball player to a year in jail for having sex with a 15-year-old girl.

The 22-year-old Fernely apologized during yesterday's hearing for the July 18th incident, in which he had sex with the victim during a party at his apartment after giving her alcohol.

The former pitcher was originally charged with first-degree felony rape and four misdemeanor counts of supplying alcohol to minors, but a plea bargain was reached in which Fernley pleaded guilty to a third-degree felony for unlawful sex activity with a minor.

Fernley was also sentenced to three years' probation and will be required to pay restitution to the victim, who is currently in a therapeutic treatment center.

During yesterday's hearing, the victim's parents testified that their daughter had gone from vibrant to withdrawn and depressed after the incident.
