(Cedar City-AP) -- The trial of Iron County Sheriff David "Dude" Benson will go on as scheduled.

Sheriff Benson faces several charges including misuse of public money, theft, stealing and witness tampering. He was scheduled to go to trial July 12, but earlier this month, the judge in the trial recused himself from the case because he said there were a backlog of cases and other trials with higher priority than Benson's.

Court records show another judge has been assigned to the case, so now the trial date will remain scheduled for July 12. A pretrial hearing scheduled for today was postponed until July 6.

Benson says he's relieved the case is going forward and says the county and the residents need to hear the circumstances surrounding the charges he faces.
