Sam Penrod reporting What was suppose to be the beginning of the murder case against Timmy Brent Olsen was delayed today.

The question of when prosecutors can try Olsen for the death of Kiplyn Davis is still up in the air.

Timmy Olsen is still in the Salt Lake County jail, preparing to begin a 12 and a half year sentence in federal prison for perjury convictions -- related to the disappearence of Kiplyn Davis. But since he is still in federal custody, he wasn't in court in Utah County today.

Utah County prosecutors filed murder charges against Olsen in January, accusing him of the murder of Kiplyn Davis back in 1995. But so far, every court hearing in the murder case has been delayed, because Olsen has been in federal custody.

According to Utah County prosecutors, Olsen will not get credit for time served on his federal conviction if he is waiting for trial in the Utah County jail, because it's considered a separate case.

Sherry Ragan, Prosecutor: "It's certainly a consideration for him, where he is looking at serving 12 1/2 years. Does he want to spend a year or two here not getting credit for that or does he want to roll the dice and go get started on his federal time... I don't know."

Olsen's Preliminary Hearing Postponed

I talked to a federal prosecutor this afternoon who told me the sentencing process with Timmy Olsen is almost finished and the door will be open in a few more days, so Utah County prosecutors can get custody of him.

The body of Kiplyn Davis has still not been found, but prosecutors believe they have enough witnesses to prove that Olsen was involved in her death.

Olsen is supposed to appear in court now on January 17th.
