PARK CITY — Park City Councilman Jeremy Rubell is facing a misdemeanor charge over an incident in which he is accused of cussing and yelling at a ski instructor and three Park City residents.
Rubell is charged with disorderly conduct, a class C misdemeanor, which carries a maximum of 90 days in jail and a fine of up to $750.
Rubell's attorney, Mark Moffat, said Rubell won't be making any statements to the media.
"Not only is Mr. Rubell presumed innocent, there are factual disputes in this case," Moffat said.
Police say the incident occurred on Dec. 29, 2022, at around noon, when a Nordic ski instructor employed by White Pine Touring was teaching cross-country skiing to three Park City residents.
The students — a husband, a wife and their teenage daughter — were standing with their instructor at the No. 1 tee of the Park City Golf Club, which was then serving as a cross-country ski track operated by White Pine Touring, according to charging documents.
Rubell lives in a home on Thaynes Canyon Drive, which is just adjacent to where the instructor and his students were standing. Rubell was blowing snow off the back deck of his home when he raised a middle finger at the instructor, the charges allege.
The instructor returned the gesture and Rubell "immediately lost his cool and launched into a profanity-laden tirade," according to the charges.
Rubell cussed at the skiers and threatened to "shut you (expletive) down," the charges state. The adult male student told investigators that Rubell's alleged conduct lasted four to five minutes and was "a little uncomfortable" and "unfortunate."
The teenage student told prosecutors that Rubell got "very vulgar, very quickly" and that he was "very angry."
Summit County Attorney Margaret Olson said her office is handling the case at the request of the Park City Police Department and the Park City Attorney's Office, but said she can't comment on pending matters.
Rubell's arraignment is scheduled for Feb. 27.
