ROOSEVELT — An employee at a phone store who was supposed to be helping a woman switch her data to her new device has been charged with accessing the woman's personal photos.
Marvin Abraham Herrera, 33, was charged Wednesday in 8th District Court with pornography distribution, a third-degree felony.
The investigation began Monday night when a woman contacted Roosevelt police to report that explicit photos of her were sent to her phone from an unknown number. The photos had been sent via iMessage, and because her account was shared with another family member, that family member also received the photos.
An officer traced the phone number the photos had been sent from and found it was connected to Herrera, according to a police booking affidavit. When asked if the woman knew who Herrera was, she realized it was "the man who had helped her change phones and devices earlier in the day at AT&T."
Police said moving her data to a new device "would have given Marvin access to her Apple account and iCloud, where the pictures were stored."
Upon learning this, the woman "was more upset and said she felt violated. She had only given Marvin her account information because he was an AT&T representative, and he was helping her move the account to her new device. (She) stated she didn't know or believe Marvin would keep and use the account information to go through her things and her photos," the affidavit states. "She especially didn't welcome him going through her private, explicit photos and sending them back to her."
The officer went to the AT&T store the next day where he found Herrera and asked him what had happened and why he sent the photos to the woman.
"Marvin didn't want to answer this and stated, 'I better talk to somebody,'" the affidavit states, adding that Herrera was then arrested.
