Weber investigator arrested after secret recording device discovered, police say

OGDEN — A Weber Metro Crime Scene Investigator was arrested and booked into Davis County Jail on Wednesday on suspicion of three counts of voyeurism committed against a child under 14 years of age.

Marc Swain is also facing two counts of obstruction of justice and three counts of sexual exploitation of a minor.

A probable cause affidavit states that Swain, 47, left a recording device in a bathroom on numerous occasions with the intent to capture nude images. In an interview with law enforcement, Swain said that the filming began nine months ago.

The document said a person discovered the camera "facing directly toward where she would have been undressing and the camera lens was pointing directly where she undressed."

A news release from the Weber County Sheriff's Office said the agency became aware of the criminal complaint filed through Ogden City Police Department on Tuesday. The case was transferred to Layton City Police Department due to conflict of interest.

Court documents said that a search warrant was served at Swain's residence, where various electronic devices were seized and are now being processed.

In an interview with law enforcement officials, Swain said that he knew he had made a poor decision and that "he had seen a lot of negative things and that was a causal factor in his behavior."

According to Weber County Sheriff's Office, in addition to his arrest, Swain was placed on administrative leave and an internal administrative investigation has been initiated as a result of these allegations.

"We recognize the emotional impact on public trust which arises out of these circumstances. The Weber County Sheriff's Office is committed to full cooperation with the investigating agency, ensuring due process, and maintaining public trust through transparency," Sheriff Ryan Arbon said.
