MINEOLA, N.Y. (AP) — Authorities say a New York couple who pocketed thousands of dollars in donations for a 5-year-old boy with cancer is back in custody.
Brittney Schmidt and Vincent Fina were originally expected to get probation — but they failed to appear for their sentencing last week.
Their plea deal may be rescinded and they could now face up to three years in prison.
A Long Island judge ordered Schmidt held without bail Tuesday. She's due back in court Jan. 8. Her lawyer had no comment. The judge has yet to indicate whether he may rescind the plea deal.
New York City police say Fina has been arrested in an unrelated Brooklyn robbery. It's not clear when he'll appear in the Long Island court.
Information on Fina's lawyer was not immediately available.
