SALT LAKE CITY — A man who police say was stabbed 12 times in the neck by his neighbor in an unprovoked attack on Nov. 15 has died.
Salt Lake police confirmed that the attack on Linton Livingston, 67, is now being treated as a homicide investigation and they will ask prosecutors to file amended criminal charges against Dyann Mariel Hernandez, 23. She is currently charged with attempted murder.
Hernandez, who had an ongoing dispute with her neighbor, came out of her house in the 800 block of Arapahoe Avenue on Nov. 15, walked over to Livingston, who was standing on his porch, and attacked him, according to charging documents.
Livingston "suffered 12 stab wounds to the neck and head" and his spinal cord was damaged, leaving him unable to breathe without medical assistance, according to the original charges filed in November.
Hernandez fled the scene, police say, and was arrested three days later during a routine traffic stop. Bail was set at $500,000.
Livingston succumbed to his injuries on Saturday, according to a GoFundMe campaign* started by Livingston's family to help pay for his funeral expenses.
"On Nov. 15, a monster forever changed the life of everyone in my family. My father Linton Dale Livingston, a Vietnam vet and father to eight children, grandfather to 12 grandchildren, and two great-grandchildren, was viciously attacked by his neighbor," Melody Livingston Ryan wrote. "Although my father fought hard, there were complications and his body could not continue the fight."
According to his obituary, Livingston was, "taken from this world before his time, he was a loving father, grandfather, and great-grandfather. He was an inventor, a crusader, a musician and so much more. He always made others a priority, helping everyone he could. He will be greatly missed."
Livingston's funeral is scheduled for Friday.
The stabbing occurred just one day after Hernandez was charged in a separate case with aggravated assault, a third-degree felony, and child abuse, a class B misdemeanor.
In December, Hernandez was charged in yet another case with aggravated robbery after allegedly threatening her mother and another man with a knife, according to court documents. The case was later dismissed.
