Judge to review competency of mom accused of abandoning baby

SALT LAKE CITY (AP) — A judge will consider in January the mental competency of a Utah woman accused of leaving her newborn baby in the trash to die.

Judge Elizabeth Hruby-Mills set a Jan. 11 evidence hearing on Monday in the case of Alicia Englert, who is facing an attempted murder charge.

Prosecutors have said that she should be sent to the Utah State Hospital for treatment so case can face trial. Defense attorneys question whether that's appropriate, saying she has an inherent intellectual disability.

Englert has previously been declared mentally incompetent to stand trial because her IQ is too low.

Authorities say Englert abandoned the infant in August 2014 and the baby girl would have died if she wasn't found. The child recovered and was adopted.

The case is also set for a review in October.
