BOISE, Idaho (AP) — A federal judge has dismissed a $10 million discrimination lawsuit against two top Idaho officials.
The Idaho Statesman reports (http://is.gd/60gWAP) the lawsuit filed in Boise federal court alleged that Idaho Department of Labor Director Ken Edmunds and former Idaho Human Rights Commission Director Pamela Parks discriminated against Don Dew while he was interviewing for a job as Idaho Human Rights Commission director because he has epilepsy and is gay.
Dew says he was distraught over how he was treated during the interview and voluntarily withdrew his application and filed the lawsuit on May 1.
U.S. Magistrate Judge Candy W. Dale agreed with the state and ruled that there can be no adverse employment action when a plaintiff withdraws his application from further consideration before being offered a job.
