HURRICANE, Utah (AP) -- Three former female inmates who claim they had sex with guards at a Washington County jail have filed a notice to sue to the county and the state.
The women, identified as Jane Doe I, II and III, said they were subjected to "sexual exploitation" by former Purgatory Correctional Facility guards Charles Mrkvicka and Brian Stubbs, according to the notice filed by St. George attorney Alan Boyack.
The notice does not specify what damages the women are seeking.
Mrkvicka and Stubbs pleaded guilty to felony and misdemeanor counts of sex with inmates. State law bars guards from having sexual relations with inmates and convicts on probation and parole.
Mrkvicka was sentenced in June to three years of probation and 122 days in jail. Stubbs is to be sentenced on Wednesday.
The notice stems from a sex scandal at the Purgatory Correctional Facility that surfaced in March. At least five jail employees, including Mrkvicka and Stubbs, have resigned or have been fired after they were found to have engaged in sex with inmates or knew about it.
Prosecutors are considering filing criminal charges against a third guard connected to the scandal.
