NASHVILLE, Tenn. (AP) — Defense attorneys for a second former Vanderbilt football player who was convicted in the dorm room rape of a student are asking a judge to declare a mistrial in the case.
WKRN-TV (http://bit.ly/1PWzT45) reports that Judge Monte Watkins received a motion late Tuesday from lawyers representing Cory Batey. Lawyers representing Brandon Vandenburg filed a similar motion last week, claiming a juror in the trial intentionally withheld information that he was a rape victim during the jury selection process. The lawyers say the juror was biased in his verdict.
A Nashville jury convicted both men in January of multiple counts of aggravated rape and sexual battery for the June 2013 campus assault of an unconscious female student. They are scheduled to be sentenced in June.
