MOSCOW, Idaho (AP) — A new judge has been appointed in northern Idaho to preside over the trial of a man charged with killing his estranged wife.
The Lewiston Tribune reports (http://bit.ly/1nHDs0P) in a story on Thursday that Senior Judge Carl B. Kerrick will take over after the previous judge recused himself earlier this week in 2nd District Court.
Fifty-two-year-old Charles A. Capone is charged with killing his estranged wife, 40-year-old Rachael Anderson of Clarkston, Washington, in April 2010. Charging documents allege her body was thrown into the Snake River, but it hasn't been recovered.
Capone has pleaded not guilty to first-degree murder and failure to notify a coroner or law enforcement about a death.
Kerrick is a retired judge from Nez Perce County. He has set a new trial date for Sept. 2.
