AVON, Ohio (AP) - A mental evaluation has found that a 90-year-old Ohio man is competent to stand trial for allegedly suffocating his ailing 85-year-old wife to end her suffering.

Attorneys for Robert Shaw of Avon agreed with prosecutors Monday that the court can consider the mental evaluation finding Shaw sane when Virginia Shaw died in November 2008. They agreed Shaw is able to assist in his own defense.

The judge in Lorain County is expected to make an official ruling this week to include the findings in evidence at Shaw's trial in June.

The (Lorain) Morning Journal reports that Shaw faces aggravated murder and other charges in his wife's death at their home in Avon, west of Cleveland.

Previous evaluations also found Shaw competent for trial.
