SANDY -- A Utah couple is suing over baby formula that possibly contained parts of beetles and they say made their infant sick.
Adam and Amanda Oettli of Sandy filed the suit against Abbott Laboratories in 3rd District Court Monday. They contend that the formula manufacturer knew there was a problem long before a recall was issued in September 2010.
Abbott pulled the 34-ounce sizes of Similac Advance, Similac Sensitive, Similac Isomil or Soy Isomil, and Similac Organic. Apparently they were sold at Costco.
According to the recall, an internal quality review detected "the remote possibility of the presence of a small, common beetle in the product produced in one production area in a single manufacturing facility."
The Oettlis' child was on the formula for roughly eight months starting in March of 2009.
According to the Oettli's lawsuit, their baby suffered projectile vomiting, acid reflux, gastrointestinal discomfort, constipation and extensive daytime and nighttime crying. The couple contends some of the symptoms continued after they stopped giving the formula.
The lawsuit says four complaints were made to the Food and Drug Administration before the recall. It states the company "elected to keep this information from the public and continued to sell the tainted, insect-infected product."
The lawsuit doesn't state how much in damages the family is seeking.
Abbott Labs is reviewing the lawsuit.
