PROVO — A new trial date has been set for an Orem man accused of fatally shooting his brother-in-law.

The five-day trial for Steve Strate, 55, who is charged with murder, a first-degree felony, in connection with the death of Marvin Sidwell, 51, is set to begin Aug. 29.

Strate said he was acting in self-defense on Oct. 25, 2009, when Sidwell attacked him with a stool in the basement of the Orem home where Sidwell lived with his mother. Sidwell was shot five times.

Toxicology tests showed Sidwell had methamphetamine in his bloodstream when he died. His mother testified at a preliminary hearing that the two men were arguing because Sidwell had threatened a neighbor he thought was going to buy the house.

A trial date had been slated to begin last September, but was later cancelled "due to missing reports from the crime lab," court records state.
