(KSL News) The man accused of kidnapping Elizabeth Smart is scheduled to be in court this morning.
At issue is whether Brian David Mitchell's competency hearing should be open to the public.
Earlier this month, a judge ruled that reporters will be allowed to sit in on today's hearing, which will deal with whether Mitchell's competency arguments should be heard in open court.
Mitchell's lawyers argue that by allowing the media in, Mitchell's right to a fair trial is compromised. Media outlets say by refusing coverage First Amendments rights are being violated.
