Convicted University of Utah groper now charged with exposing himself at gym

FARMINGTON — A man sent to prison nearly seven years ago for a series of gropings around the University of Utah has now been charged with exposing himself to women at a gym, according to police.

Gary Winston Fotheringham, 39, of American Fork, was charged Wednesday in Davis County’s 2nd District Court with lewdness by a registered sex offender, a third-degree felony.

On Jan. 11, two women were working out at VASA Fitness in Kaysville, 170 W. 200 North, when they noticed Fotheringham “sitting on some equipment directly behind them and watching them for an extended period of time. One of the victims then observed the defendant lift a towel that he had draped over his shorts and move his shorts to the side,” according to charging documents.

The woman told another woman what had happened. They then observed Fotheringham expose himself again “while looking directly at them,” the charges state.

Fotheringham is a registered sex offender in Utah.

In 2013, he made headlines for being convicted in connection with a series of gropings at the University of Utah.

Fotheringham was convicted of three counts of attempted forcible sexual abuse, a third-degree felony, and sentenced to up to five years at the Utah State Prison. In that case, Fotheringham watched women change in a locker room of the Marriott School of Dance before walking around campus and inappropriately touching several women at random, according to charging documents.

Court records show Fotheringham was also convicted of patronizing a prostitute in October, and twice of lewdness in 2011 in separate cases that also occurred near the university.

He is also currently charged with threatening to use a weapon in a fight, disorderly conduct and trespassing in another Davis County case.
