SYRACUSE, N.Y. (AP) - A judge has declared a mistrial in the lawsuit brought against 1980s pop star Rick Springfield by a fan who claims he fell on her during a 2004 show in upstate New York, injuring her.
State Supreme Court Justice Anthony Paris granted the mistrial request Wednesday from Springfield's lawyer to give him time to interview newly emerged witnesses. The judge gave the lawyers 90 days to investigate the new claims.
The lawsuit filed by 43-year-old Vicki Calcagno of Liverpool claims she suffered a concussion and permanent injuries when Springfield fell into the crowd during his concert at the state fairgrounds in August 2004. Calcagno testified that Springfield's buttocks landed on her head.
Springfield said he did not remember injuring anyone during the show.
