Ex-officer pleads no contest in teen sex abuse case

LOGAN — A former part-time officer for both the Logan Police Department and Cache County Sheriff's Office has pleaded no contest to forcing a teenage girl to have sex with multiple teen boys over several years.

Cody C. Smith, 40, of Logan, pleaded no contest Monday to two counts of aggravated sexual abuse of a child, a first-degree felony. When he is sentenced on March 11, prosecutors will seek consecutive sentences of six years to life in prison. Smith will ask the judge to have the sentences run concurrently, according to court records.

After entering his plea, Smith asked the judge whether he could remain free until sentencing "to get his affairs in order," according to court records. But "due to the nature of the offenses," 1st District Judge Brian Cannell ordered Smith to be taken into custody immediately.

Originally, Smith was charged with two counts of rape of a child, three counts of rape, object rape, forcible sexual abuse and two counts of aggravated assault. He pleaded no contest to the two aggravated sexual abuse of a child charges as part of a plea deal when a fifth amended information against him was filed this week.

According to the original arrest warrant affidavit, the girl was 13 years old when Smith told her and a 13-year-old boy to "go upstairs and start to undress, kiss and have sex." The boy told Smith he was "LDS and naive" but Smith kept walking into the room to give instructions and forced them, the charges states. This was repeated about six times through 2012, according to court records.

Between January 2013 and February 2014, a similar scenario allegedly happened with three other boys. In each case, Smith would "consistently" tell the boys to "go upstairs and have sex" with the girl, according to the charges. In most cases, police say Smith would yell at the couple through a door.

One boy told investigators he engaged in sexual intercourse with the girl because he "felt like that was the only way he was going to get out of there, because it was late and it was a school night," the charges state.

On another occasion, Smith ordered a boy and the girl to have sex while he left to get fast food. When he returned they told him they had done what he told them, but he said he didn't believe them and wouldn't give them their food until they repeated his order, according to court documents.

Prosecutors asked for a special setting for his sentencing hearing, noting that there may be a lot of victims and family members who want to address the court that day.

The plea deal came in the middle of Smith's trial.
