Martin MacNeill files appeal of murder conviction

PROVO — Martin MacNeill, a former Pleasant Grove doctor who was sentenced to prison a little over a week ago for the 2007 murder of his wife, has already filed an appeal.

On Monday, MacNeill and his attorney, Randall Spencer, filed notice in 4th District Court that they plan to appeal his murder conviction and sentence to the Utah Court of Appeals, "as well as all prior interlocutory orders issued in this matter."

MacNeill, 58, was sentenced to 15 years to life for killing Michele MacNeill, and one to 15 years in prison for obstruction of justice. Fourth District Judge Derek Pullan ordered both sentences to run consecutively, meaning he cannot begin serving time on one sentence until the first one is completed.

In addition, Pullan ordered that MacNeill — who was sentenced in an unrelated case to one to 15 years in prison for sexually abusing his daughter in 2007, three months after her mother's death — also serve that sentence consecutively with the others.

Prosecutors said following MacNeill's sentencing that they expect he will die in prison.

Michele MacNeill died in the bathtub of their Pleasant Grove home in 2007 following cosmetic surgery that was pushed on her by her husband, a doctor, who forced her to continuously take prescription medication after the surgery. The state successfully argued that Martin MacNeill wanted to kill his wife to begin a new life with his mistress, Gypsy Willis.
