CHARLOTTESVILLE, Va. (AP) — Five former University of Virginia swim team members are asking a federal judge to dismiss a lawsuit accusing them of hazing.
The Daily Progress reports (http://bit.ly/1ls8aQv ) that U.S. District Judge Norman K. Moon heard arguments on the motion Monday but did not immediately rule.
Anthony Marcantonio filed the lawsuit in June. He says he was subjected to hazing, assault, battery and other offenses during the team's "Welcome Week" activities in August 2014. Marcantonio says he and other first-year swimmers were coerced into drinking liquor and prune juice, grabbing teammates' genitals, and eating live goldfish.
The defendants are Kyle Dudzinski, Luke Papendick, Charles Rommel, David Ingraham and Jacob Pearce. Their attorneys say Marcantonio was a willing participant in the activities and was not injured.
A jury trial is set for September.
