OGDEN, Utah (AP) — A 36-year-old man shot and critically wounded by police inside an Ogden restaurant last month has been arrested following his release from the hospital.

Leonard Marion of Ogden was charged Tuesday in 2nd District Court with aggravated attempted murder and other crimes in the Nov. 20 incident at Lee's Mongolian BBQ.

According to charging documents, drug agents went to the restaurant to arrest Marion for an earlier incident when he fled from police.

As Marion was leaving the restaurant, agents informed him he was under arrest and tried to take him into custody.

Marion is accused of pulling out a handgun and firing one shot at the officers.

An officer returned fire, striking Marion three times.

Utah court records show he has a history of drug-related crimes.
