SALT LAKE CITY (AP) — Gov. Gary Herbert will consider a bill that will keep an annual Oktoberfest from being a sober affair.

The Senate unanimously voted on Thursday to approve a bill that would clarify how the state alcohol commission considers permits for special events. Instead of saying the commission "may" grant the permit, the law would change the wording to "shall."

The House has already approved the bill.

In 2014 the liquor board used a stricter definition of state law when considering withholding a permit for Snowbird Ski Resort's Oktoberfest.

Commissioners said the permits were designed for events put on by nonprofits and charitable organizations that benefit the community.

Lawmakers on Thursday said their dry Oktoberfest made international news and was an embarrassment.
